Packaging

From January 1, 2025, it is mandatory for all companies with producer responsibility for packaging to be a member of a collective scheme.

Batteries

From 18 August 2025, companies that put batteries on the Danish market will have to meet a number of new requirements, and possibly be a member of a collective scheme.

What is manufacturer responsibility for packaging?

Producer responsibility for packaging is a piece of legislation that ensures that companies take responsibility for the packaging they put on the market. It involves requirements to collect, recycle and report packaging waste to reduce environmental impact.

The rules vary for each product area, so it's important to be aware of the specific requirements for the specific products your company handles.

Producer responsibility stems from EU Directive 94/62/EC, and in Denmark has had manufacturer responsibility for batteries and electronics for almost 20 years. Its purpose is to promote recycling, recycling and reduce environmental impact throughout the product lifecycle.

Who is subject to producer responsibility?

Producer responsibility applies to all companies that produce, import or sell packaged products in Denmark. This includes
Producers: Companies that manufacture products with packaging.
Importers: Companies that import products with packaging from abroad to the Danish market.
Sellers: Companies that sell packaged products directly to consumers or other businesses.

On which products is there producer responsibility?

Producer responsibility for packaging in Denmark applies to all products whose packaging ends up as waste, including plastic, cardboard, metal, glass and composite materials.

For example, a cordless screwdriver may be subject to manufacturer liability for:
Packaging: E.g. the box and the plastic wrap
Batteries: Built-in or supplied battery
Electronics: The screw machine itself
Therefore, your company should always investigate which parts of your products are covered by the different regulations, so that you ensure proper handling and reporting in all relevant areas.
