Terms and Conditions

These terms and conditions apply to all new members registered after 22 March 2026 and to existing members from 22 April 2026 – the latter can find the previous terms and conditions here.

2. Definitions

2.1) Emballage Indberetning: The collective scheme Emballage Indberetning ApS, CVR no.: 45304418.

2.2) The Member: A natural or legal entity that has entered into an agreement with Emballage Indberetning ApS as a collective scheme, pursuant to relevant EU or national legislation on producer responsibility, whether relating to packaging, single-use plastics, fishing gear, electronics, or batteries.

2.3) Legislation: The legislation on producer responsibility for packaging, single-use plastics, fishing gear, electronics, and batteries as applicable from time to time.

2.4) The Conditions: The Terms and Conditions of Emballage Indberetning as applicable from time to time.

2.5) The terms Producer, Importer, Distributor, Authorised Representative, and packaging shall have the same meaning as in the Legislation.

3. Entering into Agreement and Acceptance of Conditions

3.1) The agreement between Emballage Indberetning and the Member is only concluded upon the Member’s payment of the membership fee. Emballage Indberetning’s obligations as a collective scheme on behalf of the Member therefore only commence upon the Member’s payment of the membership fee.

3.2) By paying the membership fee, the Member accepts the Conditions, which have been made available to the Member prior to payment.

4. Scope of Application

4.1) The Conditions apply to all matters between Emballage Indberetning and the Member, unless other, more specific terms and conditions have been agreed between the parties, in which case the more specific conditions shall take precedence.

4.2) If a separate written agreement has been entered into between Emballage Indberetning and the Member and there are conflicting provisions between such an agreement and the Conditions, the separate written agreement shall take precedence over the Conditions.

5. Membership Period

5.1) Membership runs for a period of 12, 24, or 36 months as selected by the Member upon registration.

5.2) If membership is not cancelled, it will be automatically renewed for an equivalent period in accordance with the prices applicable at the time. Upon renewal, a payment deadline of 7 days applies. If payment is not made on time, Emballage Indberetning may thereafter charge the amount directly to the Member’s account.

6. Cancellation

6.1) Cancellation of membership must be made in writing and takes effect immediately upon Emballage Indberetning’s receipt of the notice of cancellation. Upon cancellation, the Member must simultaneously declare the quantity of packaging, single-use plastics, fishing gear, electronics, and/or batteries placed on the market and made available in the current month/quarter up to the date of cancellation.

6.2) In the event of cancellation prior to the expiry of the chosen membership period, no pro-rata refund of the membership fee will be made.

7. Member’s Obligations

7.1) The Member is responsible for and obliged to:

7.1.1) Provide accurate, complete, and timely information on the quantity and type of packaging, single-use plastics, fishing gear, electronics, and/or batteries placed on the market, in accordance with the Legislation. Information must be provided in accordance with Emballage Indberetning’s instructions and reporting form.

7.1.2) Comply with reporting deadlines set by Emballage Indberetning. Emballage Indberetning is entitled to set a provisional estimate of quantities made available if the Member has not reported in time.

7.1.3) Inform Emballage Indberetning of changes in the company’s ownership, address, or contact details.

7.1.4) Pay invoices promptly and correctly to Emballage Indberetning, whether these relate to membership fees, environmental contributions, disbursements to authorities, or otherwise.

7.2) The Member warrants the accuracy of reported data.

7.3) If the Member has provided incorrect information, the Member must notify Emballage Indberetning as soon as reasonably practicable.

7.4) Failure to report or provision of inaccurate information may result in:

7.4.1) A demand for supplementary payment

7.4.2) Charging of fees for administrative handling

7.4.3) Invoicing on the basis of estimated quantities

7.5) The Member is obliged to grant Emballage Indberetning access to and the opportunity to carry out self-audits at the Member’s premises in accordance with the Legislation. The Member is obliged to actively and loyally assist Emballage Indberetning in carrying out self-audits, including by providing Emballage Indberetning with access to data, systems, and documentation relating to quantities and other information requested by Emballage Indberetning. Emballage Indberetning must give reasonable notice of the self-audit of a minimum of 5 days.

7.6) The costs associated with carrying out a self-audit shall be borne by:

7.6.1) The Member, if it is established that the information reported by the Member was not correct.

7.6.2) Emballage Indberetning, if it is established that the information reported by the Member was correct.

7.7) The Member’s failure to comply with the obligations set out in the Conditions and/or the Legislation constitutes a material breach and releases Emballage Indberetning from the obligation to perform its services.

8. Emballage Indberetning’s Obligations

8.1) Emballage Indberetning undertakes to fulfil the duties of collective schemes as further described in the Legislation, including:

8.1.1) Reporting of the Member’s quantities.

8.1.2) Collection and settlement of statutory charges and fees.

8.2) Emballage Indberetning may at any time engage subcontractors to carry out Emballage Indberetning’s obligations under the agreement.

9. Prices and Fees

9.1) The Member shall pay:

9.1.1) An annual membership fee to Emballage Indberetning.

9.1.2) Any administration surcharge to Emballage Indberetning in cases of:

9.1.3) A registration fee to Dansk Producentansvar as well as an annual fee to Dansk Producentansvar and the Danish Environmental Protection Agency.

9.1.4) A quantity-based contribution depending on the reported quantities and material type (environmental contribution).

9.2) The prices applicable from time to time can be accessed via Emballage Indberetning’s website: www.emballageindberetning.dk/en/priser

9.3) Payment falls due in accordance with the invoice. After the due date, Emballage Indberetning may charge the amount directly to the Member’s account.

10. Publication of Membership

10.1) The Member consents to it being disclosed on the Scheme’s website or equivalent publicly accessible lists that the company is a member of the Scheme.

11. Liability and Limitation of Liability

11.1) The Member bears full responsibility for the accuracy of reported information.

11.2) Emballage Indberetning cannot be held liable for indirect losses, operating losses, or loss of profit.

11.3) Emballage Indberetning’s total liability for any claim is limited to five times the annual membership fee paid by the Member in the relevant calendar year.

11.4) The Member agrees to indemnify and hold Emballage Indberetning harmless against any claim, loss, cost, or liability, including legal proceedings and regulatory action, arising as a result of:

If Emballage Indberetning acts as authorised representative for the Member, the indemnification also covers any fines, damages, or other expenses that Emballage Indberetning may incur in connection with civil, administrative, or criminal proceedings arising from the Member’s breach of its obligations.

12. Force Majeure

12.1) Emballage Indberetning shall not be liable for failure to fulfil its obligations under these conditions if this is due to circumstances beyond Emballage Indberetning’s control and which Emballage Indberetning could not reasonably have foreseen or avoided.

12.2) Force majeure includes, but is not limited to, regulatory orders, war, natural disasters, strikes, lockouts, fire, pandemic, failure of IT or communications systems, and similar extraordinary circumstances.

13. Amendment of Conditions

13.1) Emballage Indberetning may amend the Conditions with 30 days’ notice. Notice will be given on Emballage Indberetning’s website.

14. Personal Data

14.1) Emballage Indberetning processes personal data; please refer to the current privacy policy, which is available via the website https://www.emballageindberetning.dk/en/privatlivspolitik.

15. Governing Law and Jurisdiction

15.1) All matters between the Member and Emballage Indberetning are governed by Danish law.

15.2) Any dispute between the Member and Emballage Indberetning shall be resolved under Danish law, with the Court in Copenhagen as the court of first instance.
