Questions about producer responsibility

If you make products or packaging available on the Danish market for the first time, you are covered. That applies to producers, importers and companies selling under their own brand, including online shops and distance selling. If you are in doubt, the quiz takes a couple of minutes.
No. Foreign companies that make products available on the Danish market through distance selling or an online shop are covered too. If you are established in another EU country, the rules require an authorised representative for extended producer responsibility (EPR representative) in Denmark to handle registration and reporting to DPA (Dansk Producentansvar). If you are established outside the EU, you can register yourselves today, except for batteries, where a representative is required. We provide the role free of charge in both cases, so you can sell in Denmark without a Danish company.
Yes, and it is easy to miss. A cordless drill triggers three responsibilities at once: packaging (the box and plastic), batteries (the built-in battery) and electronics (the machine itself). We find the product areas that apply to your products, so you report correctly on all of them.
The rules have been rolled out one product area at a time. Electronics has been covered since 2005, and single-use plastic has been phased in since 2023. For packaging, extended producer responsibility took effect in 2025, for batteries new and stricter rules apply from 18 August 2025, and fishing gear was added in 2025. Vehicles have been covered for many years (current rules from 2022). Textiles follow once the legislation takes effect. We keep track of the deadlines for exactly the product areas that apply to you.
The de minimis threshold is purely a packaging rule. It does not decide whether you are covered, but how you have to report your packaging. If you make less than 8 tonnes of packaging available on the Danish market in a year, it is up to you whether to report in simplified or detailed form, the latter split by material category and eco-modulated.
The environmental contribution is paid based on the volumes you report, for example kg of packaging or number of units, not as a fixed amount. It is adjusted by eco-modulation, so products that are easier to recycle cost less. You pay according to what you actually make available on the market.
Companies that make products available on the market without being registered are called free riders, and the Danish Energy Agency actively supervises them. Missing registration, reporting or payment can lead to fines, and without registration you cannot lawfully make your products available on the Danish market. The responsibility sits with you, but we get you sorted quickly, so you do not end up as a free rider.
The Danish Energy Agency (ENS) administers and enforces the rules, supervises compliance and handles appeals. The rules themselves come from ministerial orders and from EU legislation. DPA (Dansk Producentansvar) runs the Danish producer register (Producentregistret), where you are registered and report. We are the PRO that validates your figures and handles the reporting to DPA on your behalf.
